"Carlos did get my trademark done and was knowledgeable in the trademark process and search. However, he did not double-check his work, showed up late to our meeting and gave me a deadline he missed by at least three weeks. I can overlook being late or missing deadlines, but the big mistake was Carlos using my home address against my wishes when filing with the USPTO. I clarified at least a few times how important it was to me to keep my home address private and I provided him with my PO Box. He confirmed he would take care of this on the initial filing. After he filed, I noticed my home address listed on the USPTO website. I mentioned my displeasure and asked Carlos if he could fix his error. Carlos messaged me that he would update the address with the USPTO. He took a screenshot of edits that looked official and sent this to me. Three months later, I am getting spam sent to my home address. After receiving several unwanted spam packages, I double-checked his update on the USPTO website and noticed his update did not go through. I called Carlos and messaged him asking why this did not go as planned and how important it was to again fix his error. When he called me back, he had the nerve to ask if it was urgent to get the updated address taken care of. The urgency is that you made my home address public against my wishes! He mentioned it may take up to two business days to take care of it. I checked back the next week and it's still NOT done! Finally, I made the address change myself, thankfully it went through on my first try. Never again…"

What Is a Dead Trademark?
A dead trademark is a trademark that was once registered or applied for and that the Patent and Trademark Office doesn't recognize anymore. Individuals and companies can register and use a dead trademark. When this happens, the original business can no longer use and seek protection for that trademark.
What Is a Trademark?
According to the USPTO, a trademark is a "word, phrase, symbol or design, or a combination of words, phrases, symbols, or designs, that identifies and distinguishes the source of the goods of one party from those of others." A

How to Trademark Something
How to trademark something requires several steps to take in order to trademark your intellectual property.
1. Select a Non-Generic Trademark
You cannot legally trademark something that is generic. The stronger your mark is, the easier it will be to prevent people from using it. Every mark falls into at least one of these categories.
- Fanciful: This is something like an invented word that has no real meaning.
- Arbitrary: This is an actual word that has a known meaning, but is not in any way related to the product or service that you are offering. For example, the company Apple is arbitrary because although apples are a type of fruit, the company Apple sells computers.

What is the Lanham Act?
The Lanham Act created a national trademark registration system. Enacted in 1946, this act also protects a trademark owner against others using similar marks.
The Lanham Act also provided a way for companies to watch for modifications to their trademarks. This section of the law, called trademark dilution, gives the owner of a famous trademark a way to protect it from changes. No other person or company can use the mark in a way that reduces how unique it is. The Lanham Act allows legal entities to consider the implications of issuing a trademark under the trademark laws.
Also called the Trademark Act of 1946, this legal statute oversees unfair competition laws and violations. President Harry Truman signed it into law on July 5, 1947.

What is Trademark Design?
A trademark design is any word or icon that represents a company's name, or its brands, products, or services.
Standards for Trademark Design
A company's trademark design must meet United States Patent and Trademark Office standards for uniqueness. The design cannot be too generic, and it cannot resemble a trademark applied for or registered by another company. If your company's design looks too much like another company's design, the trademark office will deny your trademark application.

Read MoreTrademark Cease and Desist
- 10 min read
A trademark cease and desist letter asks a third party to stop using a trademark in commerce. Failure to do so can lead to a lawsuit, legal action, and fees. Whether you send or receive a cease and desist letter, consult an attorney to determine the right course of action for your situation.
Why Is Trademark Cease and Desist Important?
Trademarks protect any of the following that's directly related to a company and its products or services:
- Unique business names
- Slogans or catchphrases
- Logos

- Other intellectual property
Since trademarks are used in commerce, they are important for protecting your business and its livelihood.
