"Carlos did get my trademark done and was knowledgeable in the trademark process and search. However, he did not double-check his work, showed up late to our meeting and gave me a deadline he missed by at least three weeks. I can overlook being late or missing deadlines, but the big mistake was Carlos using my home address against my wishes when filing with the USPTO. I clarified at least a few times how important it was to me to keep my home address private and I provided him with my PO Box. He confirmed he would take care of this on the initial filing. After he filed, I noticed my home address listed on the USPTO website. I mentioned my displeasure and asked Carlos if he could fix his error. Carlos messaged me that he would update the address with the USPTO. He took a screenshot of edits that looked official and sent this to me. Three months later, I am getting spam sent to my home address. After receiving several unwanted spam packages, I double-checked his update on the USPTO website and noticed his update did not go through. I called Carlos and messaged him asking why this did not go as planned and how important it was to again fix his error. When he called me back, he had the nerve to ask if it was urgent to get the updated address taken care of. The urgency is that you made my home address public against my wishes! He mentioned it may take up to two business days to take care of it. I checked back the next week and it's still NOT done! Finally, I made the address change myself, thankfully it went through on my first try. Never again…"

What Are Trademark Requirements?

Trademark requirements include details such as contact information and product description information that you must provide when you apply for a trademark. To get a trademark, you need to meet the following six requirements:

  1. Provide your name and address as owner of the trademark.

  2. State the entity type (individual or corporation) and your national citizenship.

What Is Trademark Cancellation?

Trademark cancellation is the legal process of removing a registered trademark from the books. This allows the trademark to be registered by another party.

Trademark cancellation is a legal argument under the Lanham Act. Its purpose is to allow a party to petition for removal of a trademark from the federal register. This is done by filing a Petition to Cancel, which is usually argued before the TTAB, or Trademark Trial and Appeal Board. In some cases, the argument can be litigated in federal court, and the courts can also cancel a mark in such a circumstance.

To cancel a trademark, the petitioner must prove that the mark will cause harm if it is not canceled. Because the petitioner only has

How Much Does a Trademark Lawyer Cost?

A trademark lawyer costs around $1,000 to $2,000 for the general trademark process, but disputes could cost the client an additional $300 $400 an hour.

Some of the trademark lawyer costs you may see include:

  • Filing fees for the trademark application.
  • Government costs charged by the USPTO.

Types of Costs

Registering a federal trademark in the United States includes several costs. First, a business owner pays fees to the U.S. Patent and Trademark Office (the "USPTO").
