Regardless of their issue, our clients benefit from Jim Kuhne's substantial real estate transactional and litigation experience, which spans two decades and covers a broad spectrum of real estate disciplines.

Prior to beginning his legal career, Jim spent nine years as a commercial real estate agent with a large multi-national real estate firm, where he and his team negotiated and marketed nearly $250 million of commercial real estate transactions on behalf of institutional owners, users, and developers of industrial property, including PS Business Parks, The RREEF Funds, the California Public Employees’ Retirement System (“CALPERS”), and General Motors Corporation.

Since entering the legal profession, Jim Kuhne has developed a substantial practice defending clients in the securitized real estate industry, including broker-dealers and sponsors of Tenant-in-Common programs ("TICs") and Real Estate Investment Trusts (“REITs”), both traded and non-traded.  In doing so, he has used his years of experience with real estate development, acquisition and underwriting, property management, sales (both user and investor) and leasing to assist his clients against claims of unsuitability, breach of fiduciary duty, fraud, and violation of federal and state securities laws arising from the securitization, issuance, sale, and management of numerous securitized real estate investment programs.

Jim also has deep experience in mortgage banking litigation.  In loan level and class action litigation in state and federal courts, Jim has successfully defended a wide array of matters including claims concerning predatory lending, deceptive practices, statutory consumer lending violations, wrongful foreclosure and fraud claims, promised or failed loan modifications, breached forbearance agreements, violations of the Real Estate Settlement Procedures Act ("RESPA"), the Truth in Lending Act ("TILA"), state consumer protection laws, unfair competition claims, and mechanic's lien disputes.
